MOTION IN LIMINE REGARDING OTHER PARTIES SUED
Plaintiff, Steve Simpson, by his undersigned counsel,
requests that this Court exclude evidence regarding other parties
sued and since dismissed from this litigation. In support, Plaintiffs state as follows:
In an effort to confuse this jury with misleading information,
Defendant seeks to introduce evidence that Plaintiffs have brought
suit against other defendants who have since been dismissed
from the lawsuit in an effort to ostensibly show that Plaintiffs
are on a wild goose chase to find someone culpable for Mr. Simpson’s
injuries. But the fact that the attorneys have pursued
other defendants is not relevant to the strict liability and
negligence claims brought in this case.
Even if there was no modicum of relevance, the prejudicial
value of such evidence far outweighs its probative effect because
a jury could be easily mislead into believing that those other
parties were culpable when there is no evidence that has been
offered by either party to support claims against anyone who
has been previously sued. These tactical decisions by lawyers before
trial would be misleading to anyone unfamiliar with the details
of the litigation process and, if admitted, would require testimony
with respect to why such actions were brought.
Accordingly, Plaintiffs request that such evidence should
be excluded.
